France Leads the Way: Crypto Service Provider Applications Open Ahead of MiCA Regulation

The French financial regulatory authority has officially begun accepting applications for authorization as a crypto asset service provider (CASP) under the European Markets in Crypto-Assets (MiCA) Regulation. This significant step comes as the regulation gears up for implementation by December 2024, requiring market participants to adhere to stringent rules on anti-money laundering, cybersecurity, and governance.

AMF's Initiatives for MiCA Regulation

The Autorité des Marchés Financiers (AMF) announced on August 2 that it is now open for applications. The regulator emphasized that starting from December 30, 2024, all entities wishing to offer crypto asset services within the EU must secure prior authorization.

The MiCA Regulation covers a range of services, including:

• Custody and administration of crypto assets
• Operating trading platforms
• Exchanging crypto assets
• Providing advice and portfolio management

During the transition period, which ends on June 30, 2026, existing French providers may continue operations without a European passport. However, they must obtain MiCA authorization to operate post-July 2026.

The AMF has highlighted that the MiCA requirements are more stringent compared to the existing French legislation for Digital Asset Service Providers (DASPs). They stated:

“The requirements set by the European legislators for MiCA authorization are more stringent than those stipulated in the French legislation concerning ‘enhanced’ DASP registration, and even more so for ‘simple’ DASP registration.”

The AMF encourages interested parties to prepare ahead of time and advises potential applicants to thoroughly understand the key aspects, implementation timeline, and obligations outlined in their comprehensive publication on the AMF website.
