Ripple’s chief legal officer, Stuart Alderoty, has expressed that he wouldn’t be surprised if the U.S. Securities and Exchange Commission (SEC) decides to appeal the recent ruling in the Ripple lawsuit regarding XRP. In a live interview on Cryptolaw TV, Alderoty criticized the SEC's actions, questioning their rationality and emphasizing that any appeal would likely fail.

SEC's Rationality Questioned

Alderoty stated, “If the SEC were a rational actor, they should just move on from this case,” highlighting the court's finding that “there are no victims here” and no allegations of fraud. He pointed out that the case does not advance the SEC’s core mission of protecting investors.

Despite his hope that the SEC won’t appeal, he acknowledged:

“I wouldn’t be surprised if the SEC does appeal.”

XRP’s Status Affirmed

He reiterated that XRP’s status as not a security and the secondary market trading of XRP as not security transactions is the law of the land. He added:

“That does not change even if the SEC appeals.”

Alderoty reminded viewers of the statistics surrounding appeals, stating that the Court of Appeals reverses lower courts less than 10% of the time. He expressed confidence that the ruling would withstand any SEC challenge, given the careful consideration by Judge Torres.

He concluded by urging the SEC to refocus on its core mission:

“Look, SEC, go back to your core mission of protecting investors in the market and stop focusing on cases where there was no harm to investors and there was no harm to the market.”
