Bitcoin Scam Recovery Gets Tougher
Protecting yourself from Bitcoin scams has become increasingly critical following a recent ruling from a Wake County court. This decision has made it significantly more difficult for victims to recover funds lost to these scams.
Last week, 5 On Your Side reported on Pauline Miller, a Raleigh resident who fell victim to a sophisticated scam. She was led to believe her bank account was compromised and was coerced into transferring $15,000 to a Bitcoin digital wallet to avoid losing her money.
Miller managed to deposit the money into a Bitcoin ATM. Fortunately, a detective from the Raleigh Police Department (RPD) intervened, retrieving the funds from the ATM and returning them to her. He recounted the process, stating, "He came to my house to get all the receipts, went over to that Bitcoin machine, had it taped up with crime tape, and subsequently was able to ... my money was still actually in that machine."
However, a recent court ruling has changed the landscape for victims like Miller. The judge determined that the RPD could no longer seize cash from Bitcoin ATMs with the expectation of returning it to victims, as the ATM operators have not been implicated in any wrongdoing. Once cash is deposited in exchange for Bitcoin, the ATM owner is considered the lawful owner of that cash.
While the law permits the seizure of cash as evidence of a crime, it does not allow for its return to victims. As a result, money seized by the RPD must now be returned to the Bitcoin ATM companies.
This ruling removes a significant recovery option for victims, making it more crucial for individuals to recognize and avoid scams in the first place. Detective Christopher Gay emphasized, "The big thing that we want everyone to know: No government agency or credible business will ask you to pay [or] to deposit money into a Bitcoin ATM."
With this new legal precedent, vigilance against Bitcoin scams is more important than ever.
